A storm in a tea cup, or so we hope, because we’re otherwise witnessing yet another gaffe by the MotoGP Stewards, who are already known for their incompetence.

In short, after the accident with Oliveira, Marc Marquez was sanctioned by the Stewards panel with a double long lap penalty for aggressive riding. The problem arose because, both in the notification of the sanction and also in Dorna’s statement, instead of indicating the date for applying the aforementioned sanction as “next race”,  the FIM MotoGP Stewards 'panel wrote “Michelin Grand Prix of the Argentine Republic”, in accordance with the penalty imposed for violating Article 1.21.2 of the FIM regulation.

After the sanction was presented, there was an immediate storm of conjectures, since Marc Marquez won’t be racing in the Argentine GP, because he fractured the first metacarpal of his right hand. The storm was triggered by the article written by our colleague, Simon Patterson. After having spoken with a Dorna representative (who we prefer not to mention, not only because they aren't mentioned in the article, but also because they wouldn’t be making a good impression), Simon wrote that, since Marc won’t be present in Argentina, he won’t have to face the sanction of the double long lap penalty.

While we were driving to the airport in Lisbon, we spoke to Loris Capirossi, who obviously denied this was true, and assured us that Marquez will pay the price for his mistake (hahaha!) during the following Grand Prix, in Austin.

 

E’ nella logica della sanzione, del resto. In giurisprudenza si dice Ratio legis (ragione o spirito della legge), è una locuzione latina utilizzata nel linguaggio giuridico per indicare l'elemento logico della legge ovvero il fine che ha animato il legislatore nell'emanazione della legge.

C’è bisogno di dirlo? Una sanzione è comminata affinché venga pagata. Ciò non toglie che chi ha scritto sia il comunicato che la lettera della FIM dovrebbe trovarsi un altro lavoro, o perlomeno avere una minima infarinatura di diritto per evitare di scrivere senza nemmeno capire l’importanza delle parole.

Per fortuna il diritto ha previsto anche questo: esiste infatti una interpretazione restrittiva, quando si restringe cioè il significato della parola usata dal legislatore, cioè si limita l'uso normale di quel termine; oppure una interpretazione estensiva, quando, all'opposto si estende il significato delle parole oltre l'uso cui sono normalmente destinate.

Nel caso di specie: come Gran Premio della Repubblica Argentina deve intendersi, la ‘gara successiva’. Certo, se fosse stato indicato, facciamo un esempio, un GP specifico non successivo sarebbe stato arduo argomentare (nel caso il pilota non vi avesse partecipato). Ma in questo caso possiamo tranquillamente dire e scrivere, che qualunque altra interpretazione oltre che dimostrare l’ennesima incompetenza dello steward panel, deve intendersi come un favore a Marc. Ma non pensiamo che l’incompetenza degli steward arrivi a tanto. Certo, la F1 ci ha abituato (vedi il caso Hamilton-Verstappen con l’assegnazione del titolo ad Mentula Canis) a decisioni anche peggiori. Ma vogliamo proprio copiare la F1 in tutto?
